Selling a house in probate in Arkansas

Probate is the court process that confirms who has authority to transfer a deceased person's property. It slows a sale down; it does not prevent one.

The practical question is who is authorized to sign. Once an executor or personal representative is appointed, the estate can generally contract to sell, subject to whatever the court and the will require. If the estate is small, Arkansas's small-estate affidavit process can be far faster than full probate.

We work at the pace of your attorney and title company. If your file needs sixty or ninety days, that is fine — we would rather wait than push you into something that creates title problems later.

We are not attorneys and we do not give legal advice. What we can do is give you a straight number on the property so you know what the real estate side of the estate is worth while the legal side runs its course.

When owners typically call us about this

  • Executor or personal representative already appointed
  • Estate needs a clear property value for the file
  • Court timeline that a traditional buyer won't wait through
  • Property sitting vacant while the estate is open

Questions about this

How long does probate take in Arkansas?
It varies widely by county and by how complex the estate is. Simple estates can move in a few months; contested or complicated ones take longer. Your attorney is the right source for your specific timeline.
Will you wait for the court?
Yes. We routinely hold offers open while probate runs, and we close when your attorney says the file is clear.
